By paying membership to The Gym, Barrow you are agreeing that you wish to participate in activities, which may include aerobic exercise, resistance exercise and stretching. You realise that your participation in these activities involves risk of illness, injury and even the possibility of death.
Furthermore, you understand that you are voluntarily engaging in an acceptable self-selected level of exercise and this is likely to be at times when the gym is unsupervised by a member of staff.
In consideration of The Gym and it’s staff, you do here and forever release and discharge and hereby hold harmless The Gym and it’s staff from any claims, demands, damages, rights of action, or causes of action, present or future, arising out of or connected with your participation in exercise at
The Gym including any injuries resulting therefrom.
By joining The Gym you are agreeing to release of liability which includes, without limitation, injuries which may occur as a result of (1) equipment that may malfunction or break; (2) any slip, fall, dropping of equipment ; and (3) any negligent instruction or supervision within the boundaries of Suffolk Academy.
You are accepting that the gym is likely to be unsupervised by staff and that you participate in physical exercise, in accordance with the above statements at your own risk.
By joining the gym you accept and understand that you are committing to either 6 or 12 monthly payments via a standing order. Free months will be active at the end of the membership term.
Gym Cancellation Policy
You are required to give 1 months notice writing at the end of your membership term. Email thegymbarrow@gmail.com
TERMINATION PAYMENT FOR EARLY CANCELLATION
-If you cancel your subscription during the Minimum Period, we shall be entitled to a termination payment (“Termination Payment”).
-The Termination Payment will be the total of:
- Any arrears;
- Any accumulated late payment charges that have been or will be incurred; and
- The monthly subscriptions that would otherwise have fallen due before the end of the Minimum Period.
MISSING PAYMENTS
-If you miss two payments, you will be deemed to have breached your contract.
GIVING NOTICE TO CANCEL
The Gym Barrow will continue to collect your monthly subscription after the Minimum Period/contract end date. Should you not wish to continue subscribing after the Minimum Period/contract end date, you must give notice to cancel the contract at least 1 calendar month before the final payment of the minimum period/contract end date. If you wish to cancel the contract at any time after the Minimum Period/contract end date, you must give at least 1 calendar months notice. The notice should be in writing to thegymbarrow@gmail.com PLEASE NOTE: should a payment fall within your notice period, the full instalment will be required.
COLLECTING YOUR MONTHLY SUBSCRIPTIONS
Stripe is our agent for the collection of your monthly subscriptions. Stripe will collect your subscription monthly in advance on our behalf by Standing order.
-If you fail to make a payment on time, you will incur the following charges:
- Fail to pay the subscription on the due date £15.00.
- Fail to pay the missed subscription within 7 days of the date of a reminder correspondence £30.00.
- Fail to pay the arrears and accrued charges within 7 days of the date of a Final Notice £45.00.
– Late payment charges become payable immediately when they are incurred.
The Gym (Stripe) will collect directly any Termination Payment which becomes due. Any notice served on you in accordance with the terms of this contract, will be deemed to have been delivered to you the next day after it is despatched by us, or our agent.
Pre paid upfront annual memberships will auto renew unless the membership is cancelled two weeks before the renewal date.
If you fail to pay any amount due under this agreement for a period of more than 30 days, then we may pass the debt to a third party company for collection. The costs incurred in employing the third party company will be borne by you including the costs in tracing you should you have changed address without telling us.
If you have chosen a 6 or 12-month paid monthly membership, please be aware it is your responsibility to up hold and pay those monthly payments.
It is all members responsibility to cancel their membership via the gyms website to stop any further payments being taken once the term period has been fulfilled.
We offer or give No refunds for failure to following the incorrect procedure.
